1. Introduction
Fly Ability is a registered NDIS service provider offering disability support services across various areas including daily personal activities, community participation, nursing care, household tasks, and more. By using our website or engaging our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
2. Use of Website
Fly Ability provides support and care services in accordance with the NDIS Practice Standards and Code of Conduct.
All services are delivered based on the participant’s NDIS plan, goals, and agreed service agreement.
The nature, scope, and cost of services will be clearly outlined in each participant’s Service Agreement prior to commencement.
3. Service Provision
- Fly Ability provides support and care services in accordance with the NDIS Practice Standards and Code of Conduct.
- All services are delivered based on the participant’s NDIS plan, goals, and agreed service agreement.
- The nature, scope, and cost of services will be clearly outlined in each participant’s Service Agreement prior to commencement
4. Service Agreements
Before services begin, Fly Ability will enter into a written Service Agreement with the participant or their representative.
This agreement outlines the supports to be provided, pricing, cancellation policy, and participant rights and responsibilities.
Both parties must sign the Service Agreement to confirm understanding and consent.
5. Payments and Invoicing
- All services are charged as per the current NDIS Price Guide.
- Payments can be made through NDIS-managed, plan-managed, or self-managed funding options.
- Invoices will be provided for each service period, and participants must ensure payment according to the terms stated in their agreement.
6. Cancellations
- Cancellations must be made in accordance with the NDIS cancellation policy (currently 7 days’ notice for most supports).
- If a participant cancels a scheduled service without adequate notice, a cancellation fee may apply as per the NDIS guidelines.
7. Privacy and Confidentiality
Fly Ability respects and protects your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Personal and health information collected from participants will be used solely for providing and improving our services.
Information will not be shared with third parties without your consent, unless required by law or for safeguarding purposes.

8. Participant Rights and Responsibilities
Participants have the right to:
Be treated with respect, dignity, and fairness.
Receive quality services that meet their needs and goals.
Have their personal information kept confidential.
Provide feedback or make complaints without fear of retribution.
Participants are responsible for:
Providing accurate and up-to-date information.
Informing Fly Ability of any changes to their NDIS plan or circumstances.
Treating staff and other participants with respect.
Giving adequate notice of cancellations or changes to appointments.

10. Limitation of Liability
- Fly Ability will not be held liable for any indirect, incidental, or consequential damages arising from the use of our website or services.
- We take all reasonable measures to ensure the safety and well-being of participants during service delivery.
11. Changes to Terms and Conditions
Fly Ability reserves the right to modify or update these Terms and Conditions at any time. Updates will be published on our website with a revised effective date.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising under these terms shall be subject to the jurisdiction of the Victorian courts.
